How Legalization Works in New Jersey

After-the-fact permits follow the same submission process as new construction — the difference is that the work is already in place. Your municipality reviews as-built drawings against current code and issues a certificate of approval when the work meets requirements.

Legalization isn't a penalty process — it's a documentation process. Most unpermitted work that meets current code can be permitted as-built. The goal is to get it on record.

Do I have to tear out the work to get it permitted?

Not usually. If the work meets current code, it can often be permitted as-built. In some cases minor corrections may be required. We identify those before submission.

Will I be fined for unpermitted work?

Penalties vary by municipality. Some impose fines; many do not if you proactively apply to legalize. The alternative — doing nothing — carries greater risk at sale or refinancing.

Do I need the original builder or contractor?

No. We document existing conditions based on what's in place. The original contractor is not required.

How long does it take?

Drawing preparation typically takes 5–10 business days. Municipal review timelines vary by township — typically 2–6 weeks.
